Mediation in property disputes can be an extremely effective way of resolving a dispute without the need of proceeding to Court.
There are several forms of mediation, this can be by way of a round table meeting with all parties or alternatively 'shuttle' mediation where the parties are in separate rooms and the mediator will visit each party and discuss matters separately.
Mediation can only take place with the agreement of both parties and the cost of the mediation will be equally shared between the parties. All discussions which take place during mediation are confidential and if the parties are unable to reach an amicable agreement, the matter can still proceed to Court. If an agreement has been reached the parties can agree to draft a written agreement setting out the terms of and this will become a binding contract.
